Privacy Policy for Personal Data
This Privacy Policy for Personal Data (hereinafter referred to as the Privacy Policy) applies to all information that the website/mobile application Bookstagram.kz (hereinafter referred to as Bookstagram), located at the domain name bookstagram.kz (and its subdomains), may receive about the User while using the mobile application and website bookstagram.kz (and its subdomains), its programs, and its products.
1. Definition of Terms
1.1 In this Privacy Policy, the following terms are used:
1.1.1. «Administration of the website and mobile application» (hereinafter referred to as the Administration) – authorized employees who manage the Bookstagram website/mobile application, organize and/or carry out the processing of personal data, as well as determine the purposes of processing personal data, the scope of personal data to be processed, and the actions (operations) performed with personal data.
1.1.2. «Personal data» – any information relating to a directly or indirectly identified or identifiable individual (subject of personal data).
1.1.3. «Processing of personal data» – any action (operation) or a set of actions (operations) performed with personal data, either using automation tools or without such tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.
1.1.4. «Confidentiality of personal data» – an obligation for the Operator or any other person who has access to personal data to prevent their distribution without the consent of the subject of personal data or any other lawful basis.
1.1.5. «Website/mobile application Bookstagram» – a collection of interconnected web pages hosted on the internet at the unique address (URL): bookstagram.kz, bookstagram.online, bookstagram.net, as well as its subdomains.
1.1.6. «Subdomains» – pages or a collection of pages located on third-level domains belonging to the websites bookstagram.kz, bookstagram.online, bookstagram.net, as well as other temporary pages, at the bottom of which the Administration’s contact information is listed.
1.1.7. «User of the website/mobile application Bookstagram» (hereinafter referred to as the User) – a person who has access to Bookstagram through the internet and uses information, materials, and products of the Bookstagram website.
1.1.8. «Cookies» – a small fragment of data sent by the web server and stored on the user’s computer, which the web client or browser sends back to the server with each HTTP request when attempting to open a page on the corresponding website.
1.1.9. «IP address» – a unique network address of a node in a computer network through which the User accesses Bookstagram.
2. General Provisions
2.1. The use of Bookstagram by the User means acceptance of this Privacy Policy and the conditions for processing the User’s personal data.
2.2. If the User does not agree with the terms of the Privacy Policy, they must cease using Bookstagram.
2.3. This Privacy Policy applies to the website and mobile application of Bookstagram. Bookstagram does not control and is not responsible for third-party websites that the User may access via links available on the Bookstagram website or mobile application.
2.4. The Administration does not verify the accuracy of the personal data provided by the User.
3. Subject of the Privacy Policy
3.1. This Privacy Policy establishes the Administration’s obligations to keep personal data confidential and protect the privacy of personal data that the User provides upon registration on Bookstagram or when subscribing to the information e-mail newsletter.
3.2. The personal data authorized for processing under this Privacy Policy is provided by the User by filling out forms on the Bookstagram website and includes the following information:
- 3.2.1. User’s first name, last name, and patronymic;
- 3.2.2. User’s contact phone number;
- 3.2.3. User’s e-mail address.
3.3. Bookstagram protects the data that is automatically transmitted when visiting pages:
- IP address;
- information from cookies;
- browser information;
- access time;
- referrer (address of the previous page).
3.3.1. Disabling cookies may prevent access to parts of the website that require authorization.
3.3.2. Bookstagram collects statistics about the IP addresses of its visitors. This information is used to prevent, detect, and solve technical problems.
3.4. Any other personal information not specified above (such as browsing history, browsers used, operating systems, etc.) is securely stored and not disclosed, except in cases provided for in section 5.2 of this Privacy Policy.
4. Purposes of Collecting User’s Personal Information
4.1. The Administration may use the User’s personal data for the following purposes:
- 4.1.1. Identifying the User registered on Bookstagram for further authorization.
- 4.1.2. Providing the User with access to personalized data on Bookstagram.
- 4.1.3. Establishing feedback with the User, including sending notifications, requests regarding the use of Bookstagram, processing the User’s inquiries and applications.
- 4.1.4. Determining the User’s location to ensure security, prevent fraud.
- 4.1.5. Verifying the accuracy and completeness of the personal data provided by the User.
- 4.1.6. Creating an account for using parts of Bookstagram if the User consents to account creation.
- 4.1.7. Notifying the User via e-mail.
- 4.1.8. Providing the User with effective technical support when problems arise related to the use of Bookstagram.
- 4.1.9. Sending the User special offers, newsletters, and other information on behalf of Bookstagram, with the User’s consent.
5. Methods and Terms of Processing Personal Data
5.1. Processing of the User’s personal data is carried out indefinitely, by any lawful means, including in information systems of personal data using automation tools or without using such tools.
5.2. The User’s personal data may be transferred to authorized government bodies of the Republic of Kazakhstan only on grounds and in the manner prescribed by the legislation of the Republic of Kazakhstan.
5.3. In case of loss or disclosure of personal data, the Administration has the right not to inform the User about the loss or disclosure of personal data.
5.4. The Administration takes the necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions by third parties.
5.5. The Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
6. Rights and Obligations of the Parties
6.1. The User has the right to:
- 6.1.1. Make a free decision regarding the provision of their personal data necessary for using Bookstagram and give consent to their processing.
- 6.1.2. Update or supplement the provided personal data if such data changes.
- 6.1.3. The User has the right to receive information from the Administration regarding the processing of their personal data, unless such right is restricted by applicable law. The User has the right to request the Administration to clarify, block, or delete their personal data if it is incomplete, outdated, inaccurate, unlawfully obtained, or unnecessary for the declared processing purpose, as well as take legally prescribed measures to protect their rights. To do so, it is enough to notify the Administration at the specified e-mail address.
6.2. The Administration is obliged to:
- 6.2.1. Use the collected information solely for the purposes specified in section 4 of this Privacy Policy.
- 6.2.2. Keep confidential information secret, not disclose it without the User’s prior written consent, and not sell, exchange, publish, or disclose the User’s personal data by any other means, except as provided in section 5.2 of this Privacy Policy.
- 6.2.3. Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedures generally used for protecting such information in the existing business environment.
- 6.2.4. Block the personal data related to the relevant User from the moment of the User’s, their legal representative’s, or the authorized government body responsible for the protection of personal data subjects’ rights request for verification, in case of inaccurate personal data or unlawful actions.
7. Liability of the Parties
7.1. The Administration, if it fails to fulfill its obligations, is liable for the losses incurred by the User due to the unlawful use of personal data, in accordance with the legislation of the Republic of Kazakhstan, except in cases provided for in sections 5.2 and 7.2 of this Privacy Policy.
7.2. In case of loss or disclosure of confidential information, the Administration is not liable if this confidential information:
- 7.2.1. Became publicly available before its loss or disclosure.
- 7.2.2. Was received from a third party before the Administration received it.
- 7.2.3. Was disclosed with the User’s consent.
7.3. The User is fully responsible for complying with the requirements of the laws of the Republic of Kazakhstan, including laws on advertising, copyright and related rights, protection of trademarks and service marks, but not limited to the listed ones, including full responsibility for the content and form of materials.
7.4. The User acknowledges that responsibility for any information (including, but not limited to: data files, texts, etc.) that they may have access to as part of Bookstagram lies with the individual who provided such information.
7.5. The User agrees that the information provided to them as part of Bookstagram may be an object of intellectual property, the rights to which are protected and owned by other Users, partners, or advertisers who place such information on Bookstagram.
8. Dispute Resolution
8.1. Before applying to the court with a claim regarding disputes arising from the relationship between the User and the Administration, it is mandatory to submit a claim (written or electronic proposal for voluntary dispute resolution).
8.2. The recipient of the claim must notify the claimant within 30 calendar days of receiving the claim, either in writing or electronically, about the results of the claim consideration.
8.3. If no agreement is reached, the dispute will be transferred to the Arbitration Court of Almaty.
8.4. This Privacy Policy and the relationship between the User and the Administration are governed by the current legislation of the Republic of Kazakhstan.
9. Additional Conditions
9.1. The Administration has the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy enters into force from the moment it is posted on Bookstagram, unless otherwise specified in the new version of the Privacy Policy.
